Constitution of The Republic of New Solace

Preamble

We the Senate of The Republic of New Solace hereby ordain and establish this Constitution for The Republic of New Solace for the purpose of protecting Freedom and to escape Tyranny.

Article I: The Senate

Section I

All legislative powers are to be contributed to the Senate of The Republic of New Solace who are ensured to properly handle this power granted to them. The Senate may also act as the Highest of judiciary courts.

Section II

The Senate of The Republic of New Solace is to be made up of 5 senators elected by the people of New Solace annually every February 20th. The Senate maintains the right to pick a Speaker of The Senate to oversee operations, The Speaker of The Senate may be chosen with a unanimous vote of The Senate. A Speaker of The Senate however is not required for standard operations.

Section III

In the case that there are Vacancies in the senate the votes of vacant Senators is to be counted as an “Abstain” and thus shall not be counted when votes are tallied up, for a bill to pass it requires a minimum ⅗ of voting senators to be in agreement, if a bill fails to reach this ⅗ requirement than the bill shall not pass into law. If a bill is rejected a minimum time period of 7 days is required before The Senate may vote on it again. If The Senate is at a tie, The Senate may pick one of the Department directors to weigh in on the vote.

Article II: The Courts

Section I

Judiciary powers fall to the courts, The courts are to be made up of the high court (The Senate) and a variety of lower courts for purposes such as criminal trials and lawsuits.

Section II

Citizens accused of crimes have the right to be tried in the court of law, Citizens may request an alternative judge or jury if they believe them to be biased. In the case of small crimes a judge may reside while for larger crimes a jury may be required, citizens may be prompted to serve on this jury which will be decided through a lottery system.

Article III: Rights of Citizens

Section I

All citizens of New Solace are guaranteed a right to freedom of speech. Citizens of New Solace are guaranteed a right to follow any religion of their choice, or none at all. Citizens are guaranteed a right to a fair trial, citizens accused of crimes may request an impartial jury or judge and are to be read their rights when detained. Government workers may not search or seize any citizen's property without a proper warrant to do so for a criminal investigation. Citizens are guaranteed the right not to be discriminated against on the basis of gender, religion, sexuality, ideology, race, ethnicity, or nationality. Individuals have the right of life and of existence, and such life may not be terminated by any entity. The health of any individual may not be altered by any entity, for any reason. The movements of any innocent individual shall not be subject to restrictions, as long as such movements respect the Constitution and laws of the nations. No individual shall be coerced to remain silent, or coerced to express things against her/his will, as long as such expressions respect the Constitution and laws of the nations. No individual shall be coerced to believe ideologies against her/his will. No individual shall be coerced to take actions against her/his will. Individuals are free to take any actions as long as such actions respect the Constitution and laws of the nations.

Section II

Infringement upon these rights, on any level, outside of specialty cases shall result in immediate reversment of the infringing decision/action and possible expulsion of the individual who made the infringing decision. The mentioned specialty cases may include but are not limited to necessary bills/decisions enacted for the cause of preserving New Solace, as temporary measures during wartime or by decision of The Senate.

Article IV: Impeachments, and Inability

Section I

Government officials of New Solace may be impeached by a majority vote of The Senate, in the case that The Senate cannot come to a resolution a department head shall weigh in on the vote. In the case that the Senate is considered unable to come to a resolution the Directors of the Departments may by a minimum 4/5 majority replace one of the Senators.

Section II

In the case that an official is found to be unable to carry out their duties in their position they may be replaced by vote of The Senate.

Article V: Amendments

Section I

This Constitution may be amended by a unanimous vote of all 5 senators, amendments to the Constitution are required to be publicly announced and, by petition, may be put to a popular vote among citizens of New Solace.
